These Terms of Service ("Terms") govern your use of the facilities, services, and website provided by Nexus Gaming Club ("we", "our", "us"). By entering our premises at 27, 14th Cross Rd, Sector 7, HSR Layout, Bengaluru, Karnataka 560102, India, or by using our website contact form, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
By visiting our premises, purchasing a session or membership, or submitting a contact form enquiry, you confirm that you have read, understood, and agreed to these Terms. We reserve the right to amend these Terms at any time, with the updated version posted prominently at our reception desk and on this page.
2. Eligibility
- You must be at least 13 years of age to use our services.
- Visitors aged 13–17 must have a signed parental consent form on their first visit.
- Parents or guardians are responsible for minors visiting the premises.
- We reserve the right to request valid government-issued photo ID at any time.
3. Use of Facilities
All members and guests agree to the following rules while on our premises:
- Treat all equipment with care. Any deliberate or reckless damage will be charged to the responsible party at full repair or replacement cost.
- No unauthorised software, tools, hacks, cheats, or mods may be installed on any station. Violations result in immediate removal from the premises and potential banning.
- Harassment, abusive language, or threatening behaviour towards staff or other customers will result in immediate ejection without refund.
- Food and beverages must be purchased from Level Up Café or our reception. Outside food is permitted in sealed packaging only.
- Smoking, vaping, and use of controlled substances are strictly prohibited on all premises.
- Loud or disruptive behaviour that disturbs other guests is not permitted.
- Personal belongings are your responsibility. We are not liable for lost or stolen items.
- CCTV is in operation throughout the premises for security purposes.
4. Memberships
Membership plans (Standard, Pro Gamer, Elite Nexus) are personal, non-transferable, and non-refundable after activation. Benefits are valid only for the membership holder and cannot be shared. Membership may be suspended or terminated for violation of these Terms without refund.
Membership does not guarantee session availability during peak hours. Members with booking priority will be accommodated as per their tier; however, availability cannot be guaranteed without advance reservation.
5. Session Bookings and Payments
- Walk-in sessions are subject to station availability at the time of arrival.
- VIP suite reservations are confirmed only upon receipt of a booking deposit.
- Cancellations of VIP bookings made less than 2 hours before the scheduled start time will forfeit the deposit.
- Session fees are charged per hour or per the applicable rate at the time of use. All rates are displayed at reception and may be updated periodically.
- All prices are inclusive of applicable Indian taxes (GST).
6. Intellectual Property
All games, software, and content available on our systems are licensed to Nexus Gaming Club. Copying, distributing, or recording game content for commercial use from our premises is prohibited unless prior written permission is granted. Personal streaming is permitted from designated streaming-enabled stations only.
7. Events and Tournaments
Tournament participation is subject to separate event-specific rules published at the time of each event. By registering for a tournament, you agree to those rules. Prizes are non-transferable and subject to applicable tax deductions as per Indian law.
Nexus Gaming Club reserves the right to modify, postpone, or cancel any event at its discretion. In the event of cancellation, registration fees will be refunded in full.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Nexus Gaming Club shall not be liable for:
- Loss of game progress, virtual items, or in-game data
- Interruptions to gaming sessions due to power outages, internet disruptions, or hardware failure
- Personal injury resulting from reckless behaviour by guests
- Loss or theft of personal belongings on our premises
Our liability in any event is limited to the value of the session or service fee paid.
9. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the data practices described in the Privacy Policy.
10. Photography and Media
Nexus Gaming Club may photograph or record events and general premises activity for promotional purposes. If you do not wish to appear in such material, please inform our staff. Guests may photograph personal setups and sessions for personal use; group recording that includes other guests requires visible consent from all individuals recorded.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka.
